如何仲裁

為了避免交易的雙方產(chǎn)生爭議時不好處理，合同中要有一個仲裁條款。這就是我們這次要講的內(nèi)容。
17. 仲裁條款Arbitration
如果合同雙方產(chǎn)生爭議，往往有以下幾種解決方法：
1） Negotiation 協(xié)商，也是最好的解決方式。
2） Consultation / Mediation
調(diào)解，這個時候會有第三方的介入。
3） Arbitration 仲裁，會有組織或者機構(gòu)的介入。
4） Litigation
起訴，會耗費較多的精力、時間甚至金錢。
下面是一份合同中的仲裁條款：
與合同有關(guān)的所有爭議應先通過友好協(xié)商解決。協(xié)商不成，可以向中國國際貿(mào)易促進會外貿(mào)仲裁委員會申請仲裁。仲裁應在上海進行，仲裁委員會做出的裁決為最終結(jié)果，雙方需共同遵守。任何一方不得到法院或其他部門修改仲裁裁決。仲裁費用由敗訴方承擔
All disputes in connection with the Contract or the execution thereof shall
be settled through friendly negotiations. In case no settlement can be reached
through negotiations, the case should then be submitted for arbitration to the
Foreign Trade Arbitration Commission of the China Council for the Promotion of
International Trade. The arbitration shall take place in Shanghai and the
decision rendered by the Commission shall be final and binding upon both
parties; neither party shall seek resource to the law court or other authorities
for revising the decision. The arbitration fee shall be borne by the losing
party.
